Terms of Service
The agreement between you and Rebloom when you use the site or the app. Plain language where we could manage it, legal language where we had to.
Effective · See also the Privacy Policy
The agreement
These Terms of Service ("Terms") are a legal agreement between you and Rebloom Health LLC ("Rebloom", "we", "us"), based in Minneapolis, Minnesota. They cover rebloomhealth.com, the Rebloom app at app.rebloomhealth.com, the Guide, our emails, and the provider materials we publish (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your information and is part of this agreement. If you do not agree, please do not use the Service.
Please read the sections on medical advice, emergencies and dispute resolution with particular care. They affect your rights.
Rebloom is not medical care
Rebloom provides education and support for people navigating pregnancy loss, and for the people who support them. It is not a healthcare provider, and nothing in the Service, including the Guide, the library, the week-by-week timeline, the scripts, and anything our team writes, is medical, psychological or legal advice, a diagnosis, or treatment.
- The Service does not replace your doctor, midwife, nurse, therapist or any other licensed professional, and using it does not create a provider-patient relationship with Rebloom or anyone who works with us.
- Our content is grounded in clinical guidelines and reviewed with care, but it is general, it may not fit your situation, and it may be out of date. Always follow the guidance of your own care team. If something in Rebloom conflicts with what they have told you, follow them.
- Never ignore professional advice, or delay seeking it, because of something you read in Rebloom.
Emergencies
Rebloom is not an emergency service and is not monitored around the clock. If you or someone else is in danger, call 911. If you are thinking about suicide or self-harm, call or text 988 (the Suicide and Crisis Lifeline) in the United States, or contact your local emergency number. If you have heavy bleeding, a fever, or severe pain after a loss, contact your care team or go to urgent care.
The Guide
The Guide is an artificial intelligence assistant. It is labelled as one everywhere it appears. It generates its replies with third-party AI models, using what you write and the context in your account. It may be wrong, incomplete, or say something a person would not. Treat it as a well-read friend, not a clinician.
- You are responsible for how you act on what the Guide says. Check anything that matters with your care team.
- The Guide may respond with crisis resources if what you write suggests you are in danger. This is an automated safety measure, not a clinical assessment, and it does not mean a person is watching the conversation.
- Do not use the Guide to get help in an emergency. See the section above.
- We may change the models behind the Guide, the way it works, or what it can do, at any time.
Who can use Rebloom
- You must be at least 18 years old.
- You must be able to form a binding contract, and not be barred from using the Service under any law that applies to you.
- Rebloom is built for use in the United States. You may use it from elsewhere, but we make no promise that it is appropriate or available where you are, and you are responsible for complying with your local laws.
Your account
- Give us accurate information and keep it current.
- Keep your password private and sign out on shared devices. You are responsible for what happens under your account. Tell us straight away if you think someone else has access to it.
- One person, one account. Do not share an account or create one for someone else, except that a supporter may be invited by a member.
- You can delete your account at any time in Settings. We can suspend or close an account that breaks these Terms, puts someone at risk, or that we are required to close by law. Where we can, we will tell you why.
Your network and supporters
Rebloom lets a member invite people to a private network, make specific asks, and receive offers of help. It also lets supporters see guidance written for them.
- When you invite someone, you confirm that you have their permission to give us their name and email address, and that you are comfortable with them seeing your name and what you choose to share.
- Supporters see only what a member has chosen to show them. Guide conversations, check-ins and notes are never shared, by design, and no one may try to get at them another way.
- Anyone can decline, step back or leave at any time. No one is told why, and no one owes an explanation.
- Offers of help are between you and the people in your network. Rebloom does not vet supporters, does not supervise what happens between you, and is not a party to any arrangement you make. Use your own judgment about whom to invite and what to accept.
- Be kind. A member's network exists to support them. We may remove anyone who uses it to pressure, harass or harm.
Lifetime access and payment
Some of the Service is free. The full member experience is unlocked by a single one-time purchase of lifetime access. The price is shown before you pay. There is no subscription, no renewal and no recurring charge.
- "Lifetime" means for as long as Rebloom offers the Service, for the account that made the purchase. It is not transferable to another account or person.
- Payments are processed by Stripe. By purchasing you also agree to Stripe's terms. Prices are in US dollars. The price shown is what you pay unless your location requires us to add sales tax, which is shown before you confirm.
- If Rebloom is not right for you, email us within 14 days of your purchase and we will refund you in full. After that, refunds are at our discretion, except where the law gives you a right to one.
- If we ever retire the Service, we will give paying members at least 90 days' notice and a way to download their information.
- We may offer free access, promotional codes or free periods, and we may change the price for future purchases. A change never affects a purchase you have already made.
What you write
Everything you write in Rebloom (asks, notes, messages to the Guide, care list items, the names of people and dates) is yours. You keep every right to it.
- You give us permission to store, process and display your content only as needed to run the Service for you and the people you have chosen to share with, and as described in the Privacy Policy. That permission ends when you delete the content or your account, except for copies in backups that roll over on their own.
- We do not use your content to train AI models, and we do not allow our providers to.
- You are responsible for your content. Do not post anything you do not have the right to share, including other people's private information without their permission.
- If you write to us with feedback or suggestions, we may use them without owing you anything. We would rather thank you, so tell us if you want credit.
What you may not do
Rebloom exists for people at a hard moment. Please do not:
- Use the Service for anything unlawful, or to harm, harass, threaten, impersonate or deceive anyone.
- Try to access another person's account, network, conversations or data, or to defeat the privacy protections in the Service.
- Scrape, crawl, copy or extract the Service or its content, by hand or by machine, except as our robots.txt allows for public pages, or use our content to train a machine learning model.
- Reverse engineer, probe, overload, interfere with or disrupt the Service, or introduce anything malicious.
- Use the Service to advertise, sell or solicit, or to collect information about other users.
- Use the Guide or the Service to produce medical advice for others, or present anything from Rebloom as the advice of a clinician.
- Create an account if you are under 18, or help someone under 18 do so.
Our content and your licence to use it
The Service, including the library, the scripts, the week-by-week pathways, the Guide, the provider materials, our name, logo and design, is owned by Rebloom or our licensors and is protected by copyright, trademark and other laws.
- We give you a personal, limited, non-exclusive, non-transferable licence to use the Service and its content for your own non-commercial use, or, if you are a clinician, to share our provider materials with your own patients as we have made them available for that purpose.
- You may not copy, republish, sell, sublicense or create derivative works from our content without our written permission. Quoting a short passage with credit, or sharing a link, is always fine.
- We can update, add to, or remove any part of the Service at any time. We will try not to remove anything you rely on without notice.
Clinicians and partners
If you are a clinician, clinic, health plan or employer using our provider materials or referring people to Rebloom, these Terms apply to you as well, and a separate written agreement may add to them. Our provider materials are for licensed professionals to share with their patients. They do not make Rebloom part of your care, do not make us a business associate or subcontractor unless we have signed an agreement saying so, and do not replace your own clinical judgment or your own discharge instructions. The demonstration pages on our site use fictional patients.
Third-party services and links
The Service relies on third-party providers (sign-in, hosting, payments, email and AI models, listed in the Privacy Policy) and links to outside resources such as crisis lines, clinics, support groups and articles. We do not control those services or sites, and we are not responsible for their content, availability or practices. A link is not an endorsement.
Disclaimers
We work hard to make Rebloom accurate, helpful and available. We cannot promise it will be perfect. To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that any content or Guide response will be accurate, complete or suitable for you, or that the Service will improve your health, mood or recovery. Some places do not allow some of these exclusions, so some may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Rebloom, its owners, team, contractors and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, health, income or goodwill, arising out of or related to the Service or these Terms, however caused and under any theory of liability, even if we have been told such damages were possible. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim arose and 50 US dollars.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Some places do not allow some of these limitations, so some may not apply to you.
Your responsibility to us
You agree to defend, indemnify and hold Rebloom and its team harmless from claims, damages and costs (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Service, including any claim that you gave us someone's information without the right to.
Dispute resolution and arbitration
Please read this section carefully. It affects how disputes between you and Rebloom are resolved.
- Talk to us first. If you have a problem, email hello@rebloomhealth.com and we will try to sort it out with you. Neither of us may start a formal proceeding until 60 days after one of us has sent the other a written description of the dispute.
- Arbitration. If we cannot resolve it, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court, and either of us may seek an injunction in court to protect intellectual property or the privacy of users. The Federal Arbitration Act governs this section. The arbitration will take place in Hennepin County, Minnesota, or by video, phone or written submissions, at your choice.
- Class action waiver. You and Rebloom agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative proceeding, and the arbitrator may not combine claims of more than one person.
- Thirty-day opt-out. You can opt out of arbitration by emailing hello@rebloomhealth.com with the subject "Arbitration opt-out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
- If the class action waiver is found unenforceable for a particular claim, that claim will proceed in court, and the rest of this section will still apply to every other claim.
Governing law
These Terms are governed by the laws of the State of Minnesota and the United States, without regard to conflict of law rules. Subject to the arbitration section, any claim that proceeds in court will be brought in the state or federal courts in Hennepin County, Minnesota, and you consent to their jurisdiction. If you live somewhere whose law gives you protections that cannot be taken away by contract, you keep them.
Changes to these Terms
We may update these Terms from time to time. When we do, we will post the new version here and update the effective date. For changes that matter, such as to payment, the Guide or dispute resolution, we will email you at least 14 days before they take effect. Continuing to use the Service after a change takes effect means you accept it. If you do not agree, delete your account before the change takes effect; if you have purchased lifetime access within the previous 14 days, we will refund you.
Everything else
- These Terms and the Privacy Policy are the whole agreement between you and Rebloom about the Service, and replace any earlier agreement.
- If any part of these Terms is found unenforceable, the rest stays in force.
- If we do not enforce something straight away, we are not giving up the right to.
- You may not transfer this agreement to anyone else. We may transfer it to a successor if Rebloom is acquired, and we will tell you if that happens.
- We are not responsible for delays or failures caused by things outside our reasonable control.
- The sections that by their nature should survive (what you write, our content, disclaimers, limitation of liability, your responsibility to us, dispute resolution and governing law) survive the end of this agreement.
- Notices from us go to the email address on your account. Notices to us go to hello@rebloomhealth.com.
